Grainfall — Terms of Service

Agreement to Terms

By downloading or using Grainfall ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users of the App. "We," "us," and "our" refer to Hrdlicka Apps. "You" refers to the person using the App.

Use of the App

Grainfall is a color-sorting puzzle game for personal, non-commercial use. You may use the App on any device you own or control. You agree not to:

• Reverse engineer, decompile, or disassemble the App.
• Modify, adapt, or create derivative works based on the App.
• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the App or its related systems.
• Exploit bugs or glitches to manipulate progress, daily challenges, achievements, or the in-game token economy.

In-App Purchases

Grainfall offers an optional one-time purchase ("Grainfall Premium") that unlocks full access to all levels, modes, and cosmetic content, as well as optional coin packs (consumable in-game currency). All purchases are processed by the platform store you bought through — Google Play Billing on Android, or the App Store on iOS — and are subject to that store's terms of sale (Google Play Terms of Service on Android, Apple's Terms of Sale on iOS).

Refunds. We do not process refunds directly. Refund requests must be submitted to the platform store you purchased through — Google Play on Android, or the App Store on iOS — and that store's refund policy governs all purchases.

No subscription. Grainfall Premium is a one-time purchase and coin packs are one-time purchases. There are no recurring charges.

Feature availability. We reserve the right to modify features included in Grainfall Premium in future updates. We will not remove core functionality without reasonable notice.

Unlock Tokens

Grainfall includes an in-game token system that allows you to unlock individual levels or cosmetic items without purchasing Premium. Tokens are earned through normal gameplay progression, and may also be purchased in optional coin packs. Any tokens purchased or earned within the App have no real-world monetary value, are non-transferable, and are not redeemable for cash or other compensation.

App Stores

The App is distributed through the Google Play Store (Android) and the Apple App Store (iOS). Your use of the App is also subject to the terms of the store you downloaded it from — the Google Play Terms of Service on Android, or the Apple Media Services Terms and Conditions on iOS. Neither Google nor Apple is a party to these Terms, and neither has any obligation to provide support or maintenance for the App.

Achievements & Optional Platform Services

Grainfall tracks achievements locally on your device. You may optionally connect the App to a platform gaming service — Apple Game Center on iOS, or Google Play Games on Android — to share achievements and progress with that service. These connections are opt-in and off by default: the App asks for your consent before any data is shared, and you can enable or disable sharing at any time in the App's Settings. Your use of Game Center or Play Games is subject to Apple's or Google's own terms and privacy policies. Grainfall is fully playable without connecting either service, and the App contains no global leaderboards.

Daily Challenge

Grainfall includes a daily challenge mode where all players receive the same puzzle each day. We reserve the right to modify, suspend, or discontinue the daily challenge feature at any time. Completion streaks and records are stored locally on your device and may be lost if the App is deleted or the device is reset without a backup.

Intellectual Property

All content in Grainfall — including but not limited to the app design, graphics, sounds, music, code, puzzle generation system, and cosmetic themes — is owned by Hrdlicka Apps and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App.

You are welcome to share screenshots, recordings, and results from the App on social media and streaming platforms.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of bugs. We make no warranty regarding the accuracy of daily challenge seeds, puzzle generation, or any game outcome.

To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Hrdlicka Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to the App shall not exceed the amount you paid for Grainfall Premium, or $5.00 USD if you have not made any purchase.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Iowa.

Compliance with Laws and Export Control

You agree to use Grainfall only in compliance with all applicable laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

Indemnification

You agree to indemnify and hold harmless Hrdlicka Apps and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the App, or your violation of any applicable law or the rights of a third party.

Dispute Resolution

If you have a concern or dispute, you agree to first try to resolve it informally by contacting us at support@hrdlickaapps.com. Most issues can be resolved this way.

If a dispute cannot be resolved informally, you and Hrdlicka Apps agree that it will be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

This arbitration and class-action-waiver provision does not apply to residents of the European Union or the United Kingdom. If you reside in the EU or UK, disputes will instead be resolved in the courts of your country of residence, consistent with applicable local consumer protection law.

General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hrdlicka Apps regarding Grainfall, and supersede any prior agreements or understandings.

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction — for example, in connection with a merger, acquisition, or sale of assets.

Notice to California Residents

Under California Civil Code Section 1789.3, California residents are entitled to the following consumer rights notice: the provider of Grainfall is Hrdlicka Apps, Iowa, USA, reachable at support@hrdlickaapps.com. Any optional purchases (such as Grainfall Premium or Unlock Tokens) are billed and processed entirely through the Google Play Store or Apple App Store, not directly by us. California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page and note the change in the App's release notes. Your continued use of the App after any change constitutes your acceptance of the new Terms.
