Solitaire Unlocked — Terms of Service

The Short Version

These Terms of Service ("Terms") govern your use of the Solitaire Unlocked mobile application (the "App") on Android and iOS, published by Hrdlicka Apps ("we," "us"). By downloading or using the App, you agree to these Terms.

1. License to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial entertainment. The App is free of charge and contains no advertising. Every feature of the App is available at no cost. The App offers optional in-app purchases ("Tips") as described in Section 5 below; buying a Tip is never required and grants no additional features, content, or removal of restrictions.

2. What You May Not Do

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse-engineer or attempt to extract the App's source code, except where such restriction is prohibited by law.
• Use the App in any way that violates applicable laws or app-store terms.
• Misrepresent the App as your own work or republish it under another name.

3. Intellectual Property

The App, including its code, design, graphics, and name, is owned by Hrdlicka Apps and protected by copyright and other intellectual-property laws. Klondike solitaire itself is a traditional card game in the public domain; these Terms cover our particular implementation, not the game's rules.

4. Your Saved Game

The App stores your in-progress game and settings locally on your device. We are not responsible for loss of this data — for example if you uninstall the App or change devices. There is no cloud backup, account recovery, or transfer mechanism, because there are no accounts and no servers.

5. Tips (Optional In-App Purchases)

Solitaire Unlocked includes an optional "Tip" feature that lets you voluntarily support continued development of the App. Please read the following before tipping:

• Tips are entirely voluntary. You never have to tip. The App is fully functional, ad-free, and unrestricted whether you tip or not.
• Tips buy nothing. A Tip does not unlock features, levels, card backs, content, currency, ad removal, or any other benefit. It is a gratuity for work already done, not a purchase of goods or services. You receive nothing of value in exchange, and no goods or services are promised or delivered.
• Tips are not charitable donations. Hrdlicka Apps is not a tax-exempt organization. Tips are not tax-deductible and no receipt for charitable purposes will be issued.
• Tips are one-time, not subscriptions. Each Tip is a single consumable in-app purchase. Nothing auto-renews and no recurring charge is ever created. You may tip once, many times, or never.
• Tips are not restorable. Because Tips are consumables that grant no entitlement, there is nothing to restore. If you reinstall the App or switch devices, no purchase carries over — there is no purchase to carry over. The App keeps no record that you tipped.
• The app stores handle all payments. Tips are processed exclusively through Apple's In-App Purchase system on iOS and Google Play Billing on Android, using the payment method already on file with your store account. We never see, receive, or store your payment card, bank, or billing information. Your purchase is also subject to the applicable store's terms (Apple Media Services Terms, Google Play Terms of Service).
• Prices and currency. Tip amounts are shown in your local currency before you confirm, as set by the store. Applicable taxes may be added by the store. Amounts may change over time and may vary by region.
• Refunds. Because a Tip is consumed immediately and confers no product, Tips are generally non-refundable. We do not have the technical ability to issue refunds ourselves. All refund requests must be made directly to the store that processed the payment — Apple via reportaproblem.apple.com, or Google via Google Play's refund process. Refund decisions rest solely with Apple or Google. Nothing in this paragraph limits any statutory refund, withdrawal, or cancellation right you may have under the consumer law of your country or state, including EU/UK consumer rights.
• Authorization to pay. By confirming a Tip you represent that you are of legal age to make a purchase in your jurisdiction, or that you have permission from the account holder or your parent or legal guardian to use the payment method. If you share a device or store account with a child, we encourage you to enable Ask to Buy (iOS) or purchase authentication (Android).
• No obligation created. Tipping does not create any contract for future development, support, updates, features, or preferential treatment, and does not give you any ownership, equity, license, or interest in the App beyond the license granted in Section 1.

6. The App Is Provided "As Is"

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or compatible with every device. Some deals of Klondike solitaire are mathematically unwinnable — that's the card game, not a defect.

7. Limitation of Liability

To the maximum extent permitted by law, Hrdlicka Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of your use of (or inability to use) the App. Because the App is free and collects no data, our total liability to you for any and all claims shall not exceed the greater of (a) the total amount of Tips you actually paid to us through the App in the twelve (12) months preceding the claim, or (b) one U.S. dollar ($1.00) — or the smallest amount permitted by applicable law.

8. Updates & Availability

We may release updates that change or improve the App, and we may discontinue the App at any time. Because the App works entirely offline, a discontinued version already on your device will keep working; it simply won't receive further updates.

9. Termination

These Terms are effective until terminated. Your rights under these Terms end automatically if you fail to comply with them. You may terminate at any time by uninstalling the App.

10. Governing Law

These Terms are governed by the laws of the State of Iowa, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App shall be resolved in the state or federal courts located in Iowa.

11. Compliance with Laws and Export Control

You agree to use Solitaire Unlocked only in compliance with all applicable laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

12. Indemnification

You agree to indemnify and hold harmless Hrdlicka Apps and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the App, or your violation of any applicable law or the rights of a third party.

13. Dispute Resolution

If you have a concern or dispute, you agree to first try to resolve it informally by contacting us at support@hrdlickaapps.com. Most issues can be resolved this way.

If a dispute cannot be resolved informally, you and Hrdlicka Apps agree that it will be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

This arbitration and class-action-waiver provision does not apply to residents of the European Union or the United Kingdom. If you reside in the EU or UK, disputes will instead be resolved in the courts of your country of residence, consistent with applicable local consumer protection law.

14. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hrdlicka Apps regarding Solitaire Unlocked, and supersede any prior agreements or understandings.

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction — for example, in connection with a merger, acquisition, or sale of assets.

15. Notice to California Residents

Under California Civil Code Section 1789.3, California residents are entitled to the following consumer rights notice: the provider of Solitaire Unlocked is Hrdlicka Apps, Iowa, USA, reachable at support@hrdlickaapps.com. Solitaire Unlocked is free to download and use. The only optional charge is a voluntary Tip, purchased through the Apple App Store or Google Play at the amount displayed at the time of purchase; see Section 5 of our Terms of Service. Complaints regarding a charge should be directed to the app store that processed it. California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

16. Changes to These Terms

If we change these Terms in a meaningful way, we will update the effective date at the top of this page. Continued use of the App after a change constitutes acceptance of the updated Terms.
