These terms are straightforward because Musician Toolkit is a simple, offline practice app. There are no accounts, no servers, no purchases, and no user-generated content. By downloading or using Musician Toolkit, you agree to these terms.

We grant you a personal, non-exclusive, non-transferable, revocable license to use Musician Toolkit on your Android devices, subject to these Terms and Google Play's Terms of Service.
You may not copy, modify, reverse-engineer, disassemble, decompile, or create derivative works based on Musician Toolkit or any part of it. You may not rent, lease, loan, sell, or sublicense the app or any rights to it.
The Tuner and Pitch Trainer tools require access to your device's microphone to detect the pitch of what you're playing or singing. This audio is processed entirely on your device in real time and is never recorded, stored, or transmitted anywhere. See our Privacy Policy for full details. You may deny microphone access and still use the Metronome, which requires no microphone access at all.
This pitch and frequency analysis is not biometric identification. Musician Toolkit does not create, extract, derive, or store a voiceprint or any other biometric identifier from your voice or playing. Audio exists only transiently in memory while a note is being analyzed and is discarded immediately after — nothing persists past that moment, on your device or anywhere else.
Musician Toolkit is free to use. It contains no in-app purchases, no subscriptions, and no advertising.

The app is distributed through the Google Play Store. Your use of the app is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no obligation to provide support or maintenance for the app.
Musician Toolkit and all content within it — including but not limited to the app design, graphics, sounds, code, and branding — are owned by Hrdlicka Apps LLC and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
Musician Toolkit is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of bugs, and we make no warranty regarding the accuracy of pitch detection, tuning readings, or metronome timing under all real-world conditions (background noise, device hardware variation, and so on).
To the fullest extent permitted by law, Hrdlicka Apps LLC disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Hrdlicka Apps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data or loss of practice history — arising from your use of Musician Toolkit, even if we have been advised of the possibility of such damages.
Because Musician Toolkit is free and contains no purchases, our total liability to you for any claim arising out of or related to these Terms or your use of the app shall not exceed $5.00 USD.
Musician Toolkit is a music practice app suitable for all ages. We do not collect personal information from any user, including children under 13. See our Privacy Policy for full details.
You may stop using Musician Toolkit at any time by deleting it from your device. We reserve the right to update, modify, or discontinue the app at any time without notice.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through an app update notice. Continued use of Musician Toolkit after any changes constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of Iowa, USA, without regard to its conflict-of-law principles. Any disputes arising under these Terms not subject to arbitration below shall be resolved in the courts located in Iowa.
You agree to use Musician Toolkit only in compliance with all applicable laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.
You agree to indemnify and hold harmless Hrdlicka Apps LLC, its owners, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of Musician Toolkit, or your violation of any applicable law or the rights of a third party.
If you have a concern or dispute, you agree to first try to resolve it informally by contacting us at support@hrdlickaapps.com. Most issues can be resolved this way.
If a dispute cannot be resolved informally, you and Hrdlicka Apps LLC agree that it will be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
This arbitration and class-action-waiver provision does not apply to residents of the European Union or the United Kingdom. If you reside in the EU or UK, disputes will instead be resolved in the courts of your country of residence, consistent with applicable local consumer protection law.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hrdlicka Apps LLC regarding Musician Toolkit, and supersede any prior agreements or understandings.
Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction — for example, in connection with a merger, acquisition, or sale of assets.

Musician Toolkit is free and has no charges of any kind.
