1. Overview
These Terms of Service ("Terms") govern your use of TorqueVault: Vehicle Maintenance Tracker ("TorqueVault," "the app"), developed by Michael Hrdlicka ("we," "us," or "our"), available on iOS. These Terms apply to all versions of the app unless otherwise noted.
2. Important Disclaimer
The service intervals, due-date predictions, and maintenance reminders displayed in TorqueVault are based on data you enter and general industry guidelines. They are not a substitute for the service recommendations in your vehicle's owner's manual, the advice of a qualified mechanic, or any manufacturer recall or safety notice. Always follow the guidance of a licensed automotive professional when making decisions about your vehicle's maintenance and safety. TorqueVault's service predictions are estimates only and may not reflect your specific driving conditions, vehicle condition, or manufacturer requirements.
TorqueVault does not verify the accuracy of service intervals, mileage readings, or maintenance records you enter. You are solely responsible for the information you record in the app.
3. Eligibility and Account
TorqueVault does not require you to create an account. You may use the app as long as you are at least 13 years of age (or the minimum age required by applicable law in your jurisdiction). By using TorqueVault, you represent that you meet this requirement.
4. Permitted Use
You may use TorqueVault for personal, non-commercial purposes only. You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app.
- Create derivative works based on the app or any of its components.
- Use the app in any way that violates applicable local, national, or international laws or regulations.
- Resell, sublicense, or redistribute the app or any portion of it.
5. TorqueVault Pro — In-App Purchases
TorqueVault offers an optional TorqueVault Pro upgrade (available as a one-time lifetime purchase) that unlocks additional features including custom service creation and other Pro-only functionality. All purchases are processed entirely by Apple's App Store. We do not collect, process, or store any payment information.
Restore Purchases
If you reinstall TorqueVault or switch to a new device, you can restore your Pro purchase at no additional charge using the "Restore Purchases" option in the app's Settings screen. Your purchase is tied to your Apple ID.
Refunds
All refund requests are handled directly by Apple in accordance with Apple's refund policies. We have no ability to issue refunds directly. Nothing in these Terms affects any statutory refund or cancellation rights you may have under the laws of your country or region.
6. Your Data and Privacy
Your vehicle and maintenance data is stored locally on your device. We do not have access to your data at any time. You are solely responsible for the accuracy of the information you enter and for maintaining appropriate backups of your records.

7. Third-Party Services
TorqueVault communicates with the following third-party service in the course of normal operation:
- Apple App Store / StoreKit — for processing TorqueVault Pro purchases. Subject to Apple's Privacy Policy and Apple's Media Services Terms.
TorqueVault does not use any analytics, advertising, or crash-reporting SDKs. We are not responsible for the practices or availability of Apple's services.
8. Widgets
TorqueVault includes an optional home screen widget that displays your primary vehicle's upcoming service status. The widget operates entirely on your device and does not transmit any data. Use of the widget is subject to the same Terms as the main app.
9. Intellectual Property
TorqueVault and all of its content, design, code, branding, and associated materials are the property of Michael Hrdlicka and are protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. Your download of TorqueVault grants you a limited, personal, non-exclusive, non-transferable license to use the app on your own devices for personal purposes in accordance with these Terms.
10. Disclaimer of Warranties
To the extent permitted by applicable law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the app will be error-free, uninterrupted, or that service reminders and notifications will fire without fail in all circumstances (for example, due to operating system restrictions, low-power modes, or device settings outside our control).
Service reminders are a convenience feature only. You must not rely solely on TorqueVault to manage critical vehicle maintenance. Always refer to your vehicle's owner's manual and the guidance of a qualified mechanic for your actual service schedule.
11. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use TorqueVault, including but not limited to missed services, vehicle damage, loss of data, or financial loss — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or your use of the app shall not exceed the amount you paid for TorqueVault Pro, or $10 USD, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. In those jurisdictions, our liability is limited to the greatest extent permitted by law, and nothing in these Terms removes or limits rights you have under mandatory local consumer protection laws.
12. Statutory Consumer Rights
If you are located in a jurisdiction whose laws provide consumer rights that cannot be waived by contract — including but not limited to the European Union, the United Kingdom, Australia, Canada, or any other jurisdiction with mandatory consumer protection legislation — nothing in these Terms limits or overrides those rights. Your statutory rights remain fully intact regardless of any other provision in these Terms.
13. Privacy and Data Protection
TorqueVault does not collect or transmit personal data to our own servers. Because we do not process personal data, TorqueVault operates outside the scope of obligations imposed on data controllers by regulations such as the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act (CCPA/CPRA), Canada's PIPEDA, and Australia's Privacy Act. Any data you store in the app remains on your device under your full control.

14. Governing Law and Disputes
These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict of law provisions, except where mandatory local laws in your jurisdiction require otherwise.
If you are a consumer located in the EU or UK, you may also have the right to bring a claim in the courts of your country of residence, and nothing in these Terms affects that right. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. For all other users, any disputes arising under these Terms shall be subject to the jurisdiction of the courts located in Iowa.
15. Termination
You may stop using TorqueVault at any time by deleting the app from your device. Deleting the app removes all locally stored vehicle data and receipt photos permanently. Deleting the app does not affect any Pro purchase tied to your Apple ID — you may reinstall and restore it at any time.
We reserve the right to discontinue the app or any of its features at any time. In the event of discontinuation of a paid Pro feature, we will make reasonable efforts to provide advance notice.
16. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date at the top. For significant changes, we will provide notice through App Store update notes and, where possible, inside the app. Your continued use of TorqueVault after changes are posted constitutes your acceptance of the updated Terms.
