These Terms of Service ("Terms") govern your use of WhisperKeep (the "App"), made by Hrdlicka Apps LLC ("we," "us," "our"). By downloading, installing, or using WhisperKeep, you agree to these Terms. If you do not agree, please don't use the App.
WhisperKeep is a personal voice-journaling app. It transcribes your spoken entries to text, stores them encrypted on your device, and offers optional tools like AI-generated summaries, mood/pace insights, and export. It runs entirely on-device — see our Privacy Policy for details.
WHISPERKEEP IS A JOURNALING TOOL, NOT A MEDICAL DEVICE, THERAPY SERVICE, OR CRISIS SERVICE. It does not diagnose, treat, cure, or prevent any medical or mental health condition, and it is not a substitute for professional medical or mental health care. Any on-device summaries, insights, or pattern reflections the App generates are for your personal use only and are not clinical assessments.
WhisperKeep includes an optional, off-by-default feature that can surface crisis resource information (such as the 988 Suicide & Crisis Lifeline) based on on-device text scanning. This feature is a convenience, not a safety net: it runs entirely on your device, may miss things, is not monitored by any person, and cannot contact emergency services on your behalf. Do not rely on it in an emergency — contact emergency services or a crisis line directly.
You own what you write and record in WhisperKeep. Because we have no servers and no access to your device's storage, we never see it, host it, or have any ability to access, recover, or back it up for you. You are solely responsible for keeping your own backups (for example, via iCloud Backup or the App's export feature) and for anything you choose to export or share.
You're responsible for making sure your use of the App, and anything you record or write in it, is lawful and doesn't violate anyone else's rights.
WhisperKeep offers the following, all processed by Apple through the App Store:
All purchases are billed and fulfilled by Apple and governed by Apple's own terms, including its refund policies. We do not process payments or handle refund requests directly — refunds are requested through Apple at reportaproblem.apple.com or your purchase history in Settings.
You agree not to reverse-engineer, decompile, resell, sublicense, or use WhisperKeep to build a competing product, and not to use it for anything unlawful.
WHISPERKEEP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THE APP WILL BE ERROR-FREE, THAT TRANSCRIPTION OR AI SUMMARIES WILL BE ACCURATE, OR THAT YOUR DATA WILL NEVER BE LOST — DEVICE FAILURE, LOSS, OR OS UPDATES ARE OUTSIDE OUR CONTROL SINCE WE HOLD NO COPY OF YOUR DATA.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HRDLICKA APPS LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING LOST DATA, LOST PROFITS, OR ANY OUTCOME RELATED TO DECISIONS YOU MAKE BASED ON APP CONTENT OR AI-GENERATED SUMMARIES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $20, WHICHEVER IS GREATER.
WhisperKeep is intended for users 13 years of age or older (or the minimum age required in your country to use the App Store without parental consent). We do not knowingly offer the App's crisis-resource feature or AI summarization as a substitute for parental or professional guidance for younger users.
We may update these Terms occasionally. If we do, the "Last updated" date above will change. Continuing to use the App after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Iowa, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Iowa, and you consent to that jurisdiction.
